Privacy Policy

ALL VISITORS:

TRACKING:

1. As pertains to all site visitors and as is standard on nearly all websites, USBuyBid will track all visits to our sites, both logged-in and not logged-in to both public areas and members-only areas. We track these visits to gather typical, non-personally identifiable web log statistics such as site traffic, monitor size/colors, browser type, connection type, page views, IP addresses, number of unique, return and new visitors, overall traffic patterns, etc. This is necessary to troubleshoot, improve and/or customize our website, services, tools, content and marketing.

PUBLIC AREAS:

1. Anyone, including members of the general public, may browse those portions of our site that do not require a user-name and password, without revealing any personally identifiable information. Member Dealerships may, from time to time, be featured, promoted or listed in the public areas of the USBuyBid sites, in various ways. But, we will not publish, in the public areas of our sites, the contents of any Dealership's forum or private message conversations or financial details concerning a Dealership's USBuyBid initiated transactions or a Dealership's license or tax ID numbers -- unless this information has been specifically supplied to us by the Dealership for the purpose of publication in a public-accessible area of the site or the Dealership has otherwise granted specific and explicit permission to publish such information.

MEMBERS:

ANONYMITY:

1. Upon subscription, you, your subscribed dealership location and designated members of your staff are no longer anonymous to us or to other USBuyBid members. By choosing to subscribe, you agree to provide us with personally identifiable information and further consent to our transfer, storage and display of that information, as is necessary to the successful operation of the USBuyBid family of services as a wholesale and networking platform.

PERSONALLY IDENTIFIABLE INFORMATION:

*NOTE - all collected information is also stored on our secure servers.

COLLECTION, STORAGE -- DISPLAY TO OTHER MEMBERS:

1. Member Dealership and active-listing vehicle profiles will be visible to all logged-in members of USBuyBid and will include any or all of the following information, as supplied to us: Dealership name, physical location, phone numbers, fax numbers, web site, dealer/wholesale license number (or equivalent,) Dealership tax-ID number. Preferred contact information and names for each of three designated staff positions -- Owner/GM, paperwork contact, transaction contact as well as any other information volunteered by the Member Dealership.
2. Members further provide our staff with the name, title and contact information for an individual we may contact in regards to the Dealership's subscription. When this contact differs from any of the three contacts provided for display to the full membership, this contact's supplied information will not be made available on the USBuyBid website unless the Dealership specifically provides such information in a manner that results in such a display or the Dealership specifically requests or otherwise grants specific permission for such display.
3. We further collect and store information based on your account's activities and initiated transactions on the site, including but not limited to: buybids offered, received or accepted, purchases, vehicles listed, etc. as well as any other information that may be volunteered by you or your designated staff, in any way.
   
   
   1. A buy-bid offer will be visible only to the selling and offering Dealership.
   2. The amount of an accepted buy-bid offer and the vehicle profile for any accepted but pending transaction will be visible only to the selling and buying dealership.
   3. Only the selling Dealership will have access to the full list of buy-bid offers received on a listed vehicle.
   4. Other information volunteered by a Dealership will be displayed according to the member's method of submission. (Example: Information included with a vehicle listing, will be displayed in the vehicle profile, information included in a Private Message will be visible only to that member and the recipient, etc.)

COLLECTED INFORMATION - THIRD PARTIES and USBuyBid STAFF/BOARD:

1. USBuyBid utilizes a secure third party billing service to process your subscription fees - USBuyBid does not have access to, nor do we gather, compile or store the private and highly sensitive financial information, such as credit card numbers, you provide to our secure third party billing agent, for the purpose of billing your monthly subscription fee. We collect, store and use, internally, only the information provided to us regarding your account's billing schedule, payment history and amount, your current account status with us and, if supplied to us by the agent, the reason for any failed payment. Should it become necessary to employ the services of a collection agency, we will and/or authorize our billing agent to share only that information which is necessary to collect on outstanding payments overdue.
2. USBuyBid may contract, subcontract or partner with various other third parties to help us provide, maintain and improve the USBuyBid sites, system, services and marketing. It is our policy to require that such third parties agree to conform to our privacy standards regarding our members' personally identifiable information and we will make every reasonable effort to prevent such third parties from disclosing your personally-identifiable information, except as may be necessary for the purpose of providing the services in question.
3. We may also partner or otherwise contract or make arrangements with other third parties, including paid advertisers (transport companies, insurance companies, financial institutions, etc.) to provide our members with convenient access to additional service options, etc. offered by these third parties. These third parties have their own privacy policies regarding their use of the information supplied to them. USBuyBid does not have access to, nor do we gather, compile or store any private, personally identifiable information you disclose to these third parties.
4. We do not sell or rent your personally identifiable information or otherwise intentionally make our members list or members' contact information available to third parties for their marketing purposes. (Telemarketing, spam, direct mail campaigns, etc.) We require that all individuals and companies, whether USBuyBid staff, members or other parties with access to any portion of the USBuyBid system agree not to use such access for these or any other purposes which are contrary to our Privacy Policy or Terms of Service agreement.
5. We may gather, utilize, publish, disclose and/or market aggregate, non-personally identifiable information and data collected from the use of our sites and/or services and/or collected from other companies and we reserve the right to use non-sensitive information in our own efforts to market USBuyBid and to promote the success of our member Dealerships in their use of our system.
6. We may share your information with members of our corporate team and board of directors, our employees, subcontractors, partners, attorneys, contracted service providers, etc. as is necessary to conduct daily business, comply with laws or regulations and provide, maintain or improve the site, services to our members or our marketing.
7. We may share your information with the proper department(s) in your Dealership's state of license or others as is necessary to verify that you are licensed or otherwise legally allowed to engage in the trade of vehicles on the wholesale market in the U.S.
8. We may share your information with the proper authorities in the event of a verified request, subpoena, court order or other legal procedure, regarding criminal investigations or alleged illegal activity. Further, in the event of any legal action initiated by or against USBuyBid, we will cooperate fully and disclose all requested or required information necessary to resolve such matters.
9. We may disclose your personally identifiable information to any successor-in-interest of USBuyBid, such as a company that acquires the USBuyBid corporation, through sale, merger or other acquisition of all or a portion of our assets, when such acquired assets include our subscribership, so that your service and enjoyment may continue uninterrupted. In the event that USBuyBid goes through such a transition, our members will be notified via their preferred methods of contact.

YOUR USE OF INFORMATION FROM USBuyBid:

1. USBuyBid and/or use of the USBuyBid service to network and to conduct wholesale trade requires you to share business, personal and, perhaps financial information. We encourage you and your fellow USBuyBid members to use the information to which you have access via your subscription to USBuyBid to conduct your wholesale operations, both on and off the USBuyBid system and to network, both professionally and socially with other professionals in your industry. However, we strictly forbid any other use of the information available to you via our service - particularly the gathering of information for marketing or other purposes that would violate the USBuyBid privacy policy or Terms of Service Agreement.
2. We encourage Dealerships with established privacy policies or practices of their own to include or provide a link to these policies in their Dealership profiles.

ACCOUNT PROTECTION:

1. Your Dealership is responsible for all activity that occurs on your subscribed account.
2. As a USBuyBid subscriber, it is your responsibility to protect and remember your account's USBuyBid password. If your account is compromised, it is your responsibility to notify USBuyBid and to change your password to protect your account from further compromise.
3. When setting up your account or changing passwords, use unique combinations of numbers and letters that are easy for your authorized staff to remember, but would be difficult for others to guess.
4. Change your password whenever there is a change in who among your staff is authorized to access your USBuyBid account and do not disclose your password to anyone but those staff members who are authorized to access your USBuyBid account.
5. It is strictly forbidden to allow access through your account to any member of the retail public or to share your Dealership location's account with another Dealership location or to allow any other outside third party to access the members-only areas of the USBuyBid website.

VIOLATION/REMEDIES

1. Violation of this policy will result in the removal or suspension, from our subscribership, of the Member Dealership account or accounts under which the violation occurred. We may further prevent by ban, (by IP address, domain or other means,) access to our system and sites, including, but not limited to any area that is otherwise open and accessible to the general public.
2. Violators of this Privacy Policy will be held responsible for the payment of any court costs, attorney fees, fines, lost revenues and any other expenses or damages as may be incurred by USBuyBid in enforcing this policy or resulting from the violation, thereof.

CHANGES

1. We may change or amend this Privacy Policy at any time by posting the amended terms on this site. Members will be notified of changes to this policy and all changes in terms or amended terms will automatically take effect 30 days after they are initially posted.
